Edward Parks will speak at the ABA 2024 Insurance Coverage Litigation Committee CLE Seminar on the panel “Using Insurance Assets to Resolve Mass Tort Claims in Bankruptcy: Key Issues Facing Debtors, Insurers, and Claimants.

Bankruptcy is an ever-popular tool for resolving mass tort liability, but brings with it complications for insurers. This panel will discuss the valuation of insurance assets and liabilities, the use of trusts in victim compensation, disputes of insurance asset ownership, the use of adversary proceedings in resolving insurance issues, and recent Chapter 11 case law, including the “Texas Two-Step.”

Joshua Weinberg will speak on the panel “Coverage for Supply Chain Disruptions: Caused by UFOs, Alien Abductions, or Earth-Bound Catastrophes.

This panel will use fun, sci-fi hypotheticals involving flying saucers, space debris, and alien abductions to explore coverage of different supply chain disruptions. Commercial policies may cover physical damage ranging from meteorite impacts to train hijacking, while specialized broad Supply Chain or Trade Disruption policies may cover incidents that don’t involve physical loss or damage, like the mass-abduction of a workforce by interstellar visitors.
